RES MODE SRL, in its capacity as Data Controller of your personal data, pursuant to and for the purposes of EU Regulation 2016/679, hereinafter “GDPR”, hereby informs you that the aforementioned legislation provides for the protection of data subjects with regard to the processing of personal data and that such processing will be carried out in compliance with the principles of fairness, lawfulness, transparency, and protection of your confidentiality and rights.

Your personal data will be processed in accordance with the legislative provisions of the regulation mentioned above and with the confidentiality obligations set forth therein.

Purpose and legal basis of processing
Specifically, your data will be processed for the following purposes related to compliance with legal or contractual obligations:

  • For the purpose of ascertaining, exercising, or defending a right in legal proceedings, whenever judicial authorities exercise their judicial functions.

Your data will also be used for the following purposes related to the performance of contractual or pre-contractual obligations:

  • Purposes related to the performance of a contract to which you are a party or the execution of pre-contractual measures taken at your request (e.g., registration request via the “Contact” form, etc.);

  • Technical and functional access to the website, with no data retained after the browser is closed;

Your data may be communicated to external parties for proper management of the relationship and, in particular, to the following categories of recipients, including all duly appointed Data Processors:

  • Parties necessary for the provision of services offered by the website, such as sending emails and analyzing website functionality, who typically act as data processors on behalf of RES MODE SRL.

Disclosure
Your personal data will not be disclosed in any way.

Your personal data may also be transferred, strictly for the purposes described above, to the following countries:

  • Some of your personal data may be transferred to recipients located outside the European Economic Area. RES MODE SRL ensures that both electronic and paper processing of your personal data by such recipients complies with applicable law. Transfers are alternatively based on an adequacy decision or on the Standard Contractual Clauses approved by the European Commission.

Data retention period
We inform you that, in compliance with the principles of lawfulness, purpose limitation, and data minimization, pursuant to Article 5 of the GDPR, the retention period of your personal data is as follows:

  • For no longer than is necessary for the provision of the requested services;

  • For no longer than is necessary to achieve the purposes for which the data were collected and processed, in compliance with statutory time limits.

You have the right to obtain from the Controller the erasure (“right to be forgotten”), restriction, updating, rectification, portability, objection to the processing of personal data concerning you, and, more generally, to exercise all rights provided under Articles 15, 16, 17, 18, 19, 20, 21, and 22 of the GDPR.

EU Regulation 2016/679: Articles 15–22 – Rights of the Data Subject

  1. The data subject has the right to obtain confirmation of the existence or otherwise of personal data concerning him/her, even if not yet recorded, their communication in intelligible form, and the right to lodge a complaint with the Supervisory Authority.

  2. The data subject has the right to obtain the following information:
    a. the origin of personal data;
    b. the purposes and methods of processing;
    c. the logic applied in case of processing carried out with electronic means;
    d. the identifying details of the Controller, processors, and designated representative pursuant to Article 5(2);
    e. the parties or categories of parties to whom the personal data may be communicated or who may become aware of it in their capacity as designated representative in the State’s territory, processors, or persons in charge.

  3. The data subject has the right to obtain:
    a. the updating, rectification, or, when interested, integration of the data;
    b. the erasure, anonymization, or blocking of data processed unlawfully, including those whose retention is unnecessary for the purposes for which they were collected or subsequently processed;
    c. certification that the operations under letters a) and b) have been notified, including with regard to their content, to those to whom the data were communicated or disclosed, unless this requirement proves impossible or involves a manifestly disproportionate effort compared with the protected right;
    d. data portability.

  4. The data subject has the right to object, in whole or in part:
    a. for legitimate reasons, to the processing of personal data concerning him/her, even if relevant to the purpose of collection;
    b. to the processing of personal data concerning him/her for the purpose of sending advertising material, direct sales, carrying out market research, or commercial communication.
